December 2, 2014 – New SSA Guidance Clarifies Certain IGRA Trusts Will Not Disqualify Members from SSI Benefits
NAFOA has issued a policy alert for the new SSA policy on how the Agency will evaluate Indian Gaming Regulatory Act trusts under the Supplemental Security Income program. Effective December 1, 2014, the policy clarifies the criteria members must meet in order to avoid disqualification under SSI, and apples to all minor children and legally incompetent adults who participate in an IGRA trust.
